These Terms and Conditions apply to all orders placed via the Atelier M online shop. They apply in the version in force at the time the order is placed.<\/p>\n

3. Quotation and conclusion of contract<\/p>\n

<\/p>\n

The presentation of products in the webshop does not constitute a legally binding offer.<\/p>\n

<\/p>\n

Upon completion of the ordering process, the customer makes a binding offer to purchase. The contract of sale is only concluded upon confirmation or dispatch of the order.<\/p>\n

4. Prices<\/p>\n

<\/p>\n

All prices are quoted in euros and include VAT, unless otherwise stated.<\/p>\n

<\/p>\n

Delivery charges are shown separately.<\/p>\n

<\/p>\n

We reserve the right to make errors, printing errors and price changes.<\/p>\n

5. Payment Methods<\/p>\n

<\/p>\n

Payment can be made using the payment methods available in the online shop.<\/p>\n

<\/p>\n

Payments are processed via external payment service providers or credit card providers through PAYJET.<\/p>\n

<\/p>\n

6. Delivery and shipping<\/p>\n

<\/p>\n

Delivery is made exclusively via DPD to the delivery address provided by the customer.<\/p>\n

<\/p>\n

Delivery charges are fixed prices and are shown separately during the ordering process.<\/p>\n

<\/p>\n

Shipping is free for orders over \u20ac250.<\/p>\n

<\/p>\n

The standard delivery time is 3\u20137 working days.<\/p>\n

<\/p>\n

As some of these items are handmade, limited edition or signed, delivery times may vary in individual cases.<\/p>\n

<\/p>\n

Should a work temporarily not be available, the customer will be informed.<\/p>\n

<\/p>\n

Partial deliveries are permissible insofar as this is reasonable for the customer.<\/p>\n

<\/p>\n

7. Retention of title<\/p>\n

<\/p>\n

The goods remain the property of Atelier M. Ferner until full payment has been received.<\/p>\n

<\/p>\n

8. Right of Withdrawal<\/p>\n

<\/p>\n

The statutory right of withdrawal applies in accordance with the separate cancellation policy on this website.<\/p>\n

<\/p>\n

9. Exclusion of the right of withdrawal<\/p>\n

<\/p>\n

There is no right of withdrawal for custom-made, personalised or signed items, provided these have been produced or adapted specifically to the customer\u2019s requirements.<\/p>\n

10. Warranty and Complaints<\/p>\n

<\/p>\n

The statutory warranty provisions apply.<\/p>\n

<\/p>\n

Slight colour variations between the screen display and the printed version are technically possible and do not constitute a defect.<\/p>\n

<\/p>\n

Similarly, slight variations may occur in hand-finished or artistically crafted items.<\/p>\n

<\/p>\n

Any damage caused in transit or obvious defects must be reported in writing, together with photographic evidence, immediately upon receipt.<\/p>\n

11. Copyright<\/p>\n

<\/p>\n

All works, illustrations, prints, content, texts and designs on this website are protected by copyright.<\/p>\n

<\/p>\n

The acquisition of a work does not include the transfer of usage or reproduction rights.<\/p>\n

<\/p>\n

Use, publication, reproduction or further processing without express written consent is not permitted.<\/p>\n

<\/p>\n

All images on this website are protected by copyright.<\/p>\n

<\/p>\n

12. Product presentation<\/p>\n

<\/p>\n

The images on the website are for illustrative purposes only.<\/p>\n

<\/p>\n

Frames, decorations or depicted environments are not included in the scope of delivery unless expressly stated otherwise.<\/p>\n

13. Newsletters and communication<\/p>\n

<\/p>\n

By subscribing to the newsletter, the user agrees to receive information and updates from Atelier M.<\/p>\n

<\/p>\n

Shipping is done via Klaviyo.<\/p>\n

<\/p>\n

You can unsubscribe from the newsletter at any time by clicking the unsubscribe link.<\/p>\n

14. Data Protection and Cookies<\/p>\n

<\/p>\n

Information regarding the processing of personal data, the use of cookies, Google Analytics, Meta Pixel and embedded media can be found in the privacy policy.<\/p>\n

Statistics and marketing services will only be activated once the relevant consent has been given.<\/p>\n

15. Liability<\/p>\n

<\/p>\n

Liability for damages shall only apply in cases of wilful misconduct or gross negligence, to the extent permitted by law.<\/p>\n

<\/p>\n

Liability for slight negligence is excluded, unless required by mandatory statutory provisions.<\/p>\n

16. Applicable Law<\/p>\n

<\/p>\n

Austrian law applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.<\/p>\n

For consumers, the statutory places of jurisdiction apply.<\/p>\n
