Terms and Conditions

1. Scope

These Terms and Conditions apply to all orders placed via the Atelier M online shop. They apply in the version in force at the time the order is placed.

3. Quotation and conclusion of contract

The presentation of products in the webshop does not constitute a legally binding offer.

Upon completion of the ordering process, the customer makes a binding offer to purchase. The contract of sale is only concluded upon confirmation or dispatch of the order.

4. Prices

All prices are quoted in euros and include VAT, unless otherwise stated.

Delivery charges are shown separately.

We reserve the right to make errors, printing errors and price changes.

5. Payment Methods

Payment can be made using the payment methods available in the online shop.

Payments are processed via external payment service providers or credit card providers through PAYJET.

6. Delivery and shipping

Delivery is made exclusively via DPD to the delivery address provided by the customer.

Delivery charges are fixed prices and are shown separately during the ordering process.

Shipping is free for orders over €250.

The standard delivery time is 3–7 working days.

As some of these items are handmade, limited edition or signed, delivery times may vary in individual cases.

Should a work temporarily not be available, the customer will be informed.

Partial deliveries are permissible insofar as this is reasonable for the customer.

7. Retention of title

The goods remain the property of Atelier M. Ferner until full payment has been received.

8. Right of Withdrawal

The statutory right of withdrawal applies in accordance with the separate cancellation policy on this website.

9. Exclusion of the right of withdrawal

There is no right of withdrawal for custom-made, personalised or signed items, provided these have been produced or adapted specifically to the customer’s requirements.

10. Warranty and Complaints

The statutory warranty provisions apply.

Slight colour variations between the screen display and the printed version are technically possible and do not constitute a defect.

Similarly, slight variations may occur in hand-finished or artistically crafted items.

Any damage caused in transit or obvious defects must be reported in writing, together with photographic evidence, immediately upon receipt.

11. Copyright

All works, illustrations, prints, content, texts and designs on this website are protected by copyright.

The acquisition of a work does not include the transfer of usage or reproduction rights.

Use, publication, reproduction or further processing without express written consent is not permitted.

All images on this website are protected by copyright.

12. Product presentation

The images on the website are for illustrative purposes only.

Frames, decorations or depicted environments are not included in the scope of delivery unless expressly stated otherwise.

13. Newsletters and communication

By subscribing to the newsletter, the user agrees to receive information and updates from Atelier M.

Shipping is done via Klaviyo.

You can unsubscribe from the newsletter at any time by clicking the unsubscribe link.

14. Data Protection and Cookies

Information regarding the processing of personal data, the use of cookies, Google Analytics, Meta Pixel and embedded media can be found in the privacy policy.

Statistics and marketing services will only be activated once the relevant consent has been given.

15. Liability

Liability for damages shall only apply in cases of wilful misconduct or gross negligence, to the extent permitted by law.

Liability for slight negligence is excluded, unless required by mandatory statutory provisions.

16. Applicable Law

Austrian law applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

For consumers, the statutory places of jurisdiction apply.

17. Online dispute resolution

Consumers can submit complaints to the EU’s online dispute resolution platform:

18. Severability Clause

Should any provision of these Terms and Conditions be or become invalid, in whole or in part, this shall not affect the validity of the remaining provisions.
